Assistance to Victims of Crime

The thesis deals with the assistance to victims of crime and aims to provide a comprehensive view of the issue. The purpose of this thesis is to assess the level of assistance provided in relation to its legal anchoring and subsequent application practice. The content of the thesis consists of an introduction, six chapters and a conclusion. In the first chapter the thesis is devoted to the interpretation of basic concepts related to the issue of victims of crime. It defines the victim and describes its various categorisations, including the definition of a particularly vulnerable victim. The distinction between victim and an injured party is also clarified for better orientation in the following text. The second chapter then briefly describes the development of the victim's position and role in criminal proceedings from a historical perspective, and briefly describes the basic international regulation of victims' rights with a focus on European legislation in this area. To complete the explanation of the basic concepts and the historical and international context, the third chapter deals with the concept of the victim of crime from the perspective of criminology and victimology respectively. Compensation to crime victims Abstract This diploma thesis deals with the issue of compensation to crime victims, specifically compensation provided by the state, whether under the name of financial assistance or compensation. One of the aims of the thesis was to subject the current legislation to a critical analysis and point out its possible imperfections. I also addressed the question of whether effective legislation succeeds in achieving the objectives set, namely the protection of the victim, the determination of clear conditions for the provision of compensation by the state and facilitating the victim's position in obtaining information and applying for financial assistance. Finally, the sub-objective was also to formulate de lege ferenda proposals that would help resolve the ambiguities and inaccuracies of the current legislation. The whole work is divided into five parts, including the introduction and conclusion. The first chapter is devoted to the theoretical definition of the key institutes necessary to understand the issue. Here I elaborate on the concepts of victimology and related victim facilitation, victimization and provide an overview of the most common typologies of victims. The aim of the theses is to elaborate on the problematics of theoretical aspects of victims of criminal acts. The work's main concern is the area of problematics of workplace victimization. This topic shall therefore be investigated deeply in the theoretical part of the theses as well. The practical part of the work will depict and process the specific characteristics of the mentioned problematics and in relation to it workplace victimization of employees of Czech Republic's Employment Bureau will be further looked on. In the theses we mention and define the basic terms connected to the chosen problematics. The aim of that is to point out their importance in relation to other disciplines, especially those which are related to victimological research and problematics of victims of criminal acts. Nowadays, the topic of workplace victimization, in other words victimization undergone when in work, is more and more frequently researched and looked up by laics, academic people and even the media. The dominant of the second part of the theses is a focus on employees of Czech Republic's Employment Bureau. In the work we analysed, from the data provided by the Bureau, the criminal or violent incidents which happened on the workplace there. An injured party in criminal proceedings and his/her protection The diploma thesis deals with the position of the injured party and his protection during the entire criminal proceedings and a description of the rights at his disposal in its individual phases. It draws information from legislation, literature, case law and electronic resources. The diploma thesis is divided into five chapters. The first includes the definition of the term injured party, both its positive and negative definitions. It also describes the differences between the terms 'injured party' and 'victim of a crime'. The second chapter focuses on the description of the rights that belong to all injured, as well as those that belong only to the injured, who have the status of a subject in adhesion proceedings under § 43, paragraph 3 of the Criminal Procedure Code. The most important of these rights are characterized in more detail. It is also describing the possibility of injured party to waiver his procedural rights and analyzing the problem of partial waiver. The aim of this thesis is to provide an information about victimology, especially in terms of a science regarding the victims of crime and means to help them, as well as to show how the knowledge provided by this science can be practically used to prevent crime. The thesis consists of introduction, conclusion and 6 chapters. The first chapter briefly introduces the concept of criminality, as well as the basic characteristics of the extent, structure, intensity and dynamics of criminality. It also deals with the role of criminology in relation to the research of crime and it mentions the differences between real and latent crime. The second chapter provides a comprehensive interpretation of crime prevention. First, it is anchored in the system of crime control, and then the concepts of object and subject of crime prevention are introduced. The chapter also presents the models of crime prevention, where two important ways of division are elaborated upon - the division into primary, secondary and tertiary prevention, and the division into social, situational and victimological prevention. Finally, the chapter outlines the limits of crime prevention and it also includes consideration of the role of crime prevention in the contemporary world. Assistance to victims of crime Abstract This master's thesis deals with the assistance to crime victims and it is divided into seven chapters. The first chapter is devoted to the theory of victims and defines its basic terms such as primary and secondary victimization. It also describes the history of the victim and points out the most common stereotypes in the area of attitude to victims. The main part of the thesis describes the legislation. It deals particularly with the Victims of Crime Act which strengthened the victim's position in criminal proceedings and extended their rights. The aim of the thesis is to analyze the definitions of the victim and the vulnerable victim that are contained in the act. Consequently, the purpose is to compare the terms of the victim as a subject of a special care and the injured party as a subject to criminal proceedings. The fourth chapter thoroughly analyzes the six fundamental rights of the victim, which are enshrined in the Victims of Crime Act. The thesis points out that the right to information, which on the other hand means an information duty for the Police of the Czech Republic, law enforcement authorities and entities registered in the register of aid providers, is not pursued sufficiently. The injured party in criminal procedure and his/her protection The diploma thesis deals with the position of the injured party in criminal proceedings and protection of the injured. It is divided into six chapters, the first chapter introduces the topic and the last presents the conclusions. The thesis is based on legal regulations, professional literature, case law, as well as electronic sources. The second chapter focuses on defining the concept of the injured party. It also addresses the difference between the injured party and the victim of a crime. The third chapter of the diploma thesis describes the aspects that may be used to classify the rights of the injured party. In this part of the diploma thesis, besides the first subchapter focused on the issue of classification of rights, there are four other subchapters. The first one is concerned with the rights of the injured party not entitled to monetary compensation, other than proprietary loss or surrender of unjust enrichment; the other deals with the rights of the injured party entitled to such claims.
